Please read these Terms of Service ("Terms") carefully before using the website at aestheticamedspa.com (the "Site") or booking or receiving services from Aesthetica Med Spa ("Company," "we," "our," or "us"). By accessing the Site or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.
1. Acceptance of Terms
By using this Site or booking any service at Aesthetica Med Spa, you represent that you are at least 18 years of age (or 16+ with verifiable parental consent for certain non-medical services) and have the legal capacity to enter into these Terms. These Terms constitute a binding legal agreement between you and Aesthetica Med Spa.
2. Services
Aesthetica Med Spa provides medical spa services including, but not limited to, injectable treatments, skin rejuvenation procedures, wellness programs, and body procedures. All medical services are performed or supervised by licensed medical professionals. By scheduling and receiving services, you acknowledge that results may vary and are not guaranteed. All treatments require a consultation and may be deemed inappropriate for certain individuals based on medical history or other factors determined at our discretion.
3. Appointments and Cancellations
We require at least 24 hours' notice for appointment cancellations or rescheduling. Late cancellations (less than 24 hours) or no-shows may be subject to a cancellation fee. Repeat no-shows may result in a requirement for a prepaid deposit for future appointments. We reserve the right to refuse service to any individual at our sole discretion.
4. Payments and Refunds
Payment is due at the time of service unless a financing arrangement has been established in advance through our approved providers (CareCredit or Cherry). All sales for services rendered are final — we do not offer refunds for completed treatments. Unopened retail products may be exchanged within 14 days of purchase with a receipt. Membership fees are non-refundable for the billing period in which cancellation occurs.
5. Memberships
Membership agreements are month-to-month and may be cancelled with 30 days' written notice. Membership benefits are non-transferable and may not be shared. Monthly treatments do not roll over to subsequent months unless otherwise stated. We reserve the right to modify membership benefits and pricing with 30 days' notice.
6. Informed Consent
Prior to receiving any treatment, you will be required to complete a medical intake form and sign an informed consent document. You are responsible for providing accurate and complete medical history information. Aesthetica Med Spa shall not be liable for adverse outcomes resulting from your failure to disclose relevant medical information.
7. Intellectual Property
All content on this Site, including text, images, graphics, logos, and design, is the property of Aesthetica Med Spa or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
8. User Conduct
When using this Site, you agree not to: (a) use the Site for any unlawful purpose; (b) submit false or misleading information; (c) attempt to gain unauthorized access to any portion of the Site or our systems; (d) engage in any conduct that could damage, disable, or impair our Site or servers; (e) harvest or collect user information without consent.

To the fullest extent permitted by applicable law, Aesthetica Med Spa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Aesthetica Med Spa and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the Site, violation of these Terms, or provision of false or inaccurate information.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the courts located in Travis County, Texas. You consent to the personal jurisdiction of such courts.
13. Photography and Marketing
By consenting to treatment, you do not automatically consent to being photographed for marketing purposes. Any use of before-and-after photos or testimonials for marketing will only occur with your explicit written consent. You may withdraw consent for future use at any time by contacting us in writing.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Site or services following any changes constitutes your acceptance of the revised Terms.
